administrative是法律英语中常见的形容词，掌握administrative一词的关键是熟悉该词构成的短语，以及该词与executive的区分。

administrative常见短语：

其中，administrative act，administrative action，administrative appeal 三者在记忆的时候需要注意的是：

administrative act

➊管理行为  依其管理权所从事的行为，尤指行为者在其通常职能之外所从事的行为，如法官监督法院工作人员的行为。管理行为常常要承受比行为人一般职能之内行为更大的责任风险。

❷执行行为 指为执行立法政策和立法机关已宣布的立法目的所必须从事的行为，或据以成立的组织法所规定必须从事的行为。

administrative action 遗产管理之诉，破产财产管理之诉

指债务人或破产人或利益相关人士提起的要求法院对遗产或破产企业进行管理的的诉讼。

administrative appeal行政申诉

就某一行政机关作出的决定向行政体系中较高一级的官员或机关提出的申诉。也指就某一行政机关的决定向法院提出的起诉。

值得注意的是，我们在翻译过程中经常遇到的“某某市/县工商行政管理局”，屈文生老师在《法律英语核心术语：实务基础》提到，不应译作"Commercial and Industrial Administration Bureau of City ( Prefecture) /County x",而应译为"x City ( Prefecture) / County Administration of Industry and Commerce''。 因为,"administration”一词本身便有"executive branch of a government的意思，即“行政机关、局(署)等。再如，Food & Drug Administration，就是“食品与药品(管理)局"；再如, General Administration of Customs 就是“海关总署”。

administrative与executive区别

executive多带有“执行、管理”之意。如三权分立(separation of powers ) 中的“行政”通常用executive 一词来表述，所以说，executive branch通常是指“负责执行法律的政府机关”(the branch of government responsible for effecting and enforcing laws) ; executive有时也指人——“行政长官”，如香港特首可以翻译为 "Hong Kong chief executive ”或者"Chief Executive of Hong Kong”。
