国际贸易中的carrier和shipper哪一个是承运人,哪一个是托运人?

很多关于国际贸易英文书籍中,尤其在关于跨国货物运输中经常会出现 “carrier” 和 “shipper”两个词,从字面上来看,两个单词都是指“做…的人”。“carrier”是指somebody who carry, 其意思是一般指运输线上的“托运人”,不管是海上运输,或者是公路运输,或者是铁路或者其他运输方式。而“shipper”,当ship 作动词的时候也有运输的意思,但是此时shipper就不能表示为托运人了,在国际货物买卖中,shipper一般是指将货物发往目的地的发货人(the person who ships the goods),一般指国际货物运输中的“卖方”。
例
1.The bill of lading is evidence of the agreement between the shipper(卖方) and the carrier(承运方) for transportation of the goods.
2.A bill of lading is the document that a carrier(承运方) issues after it has loaded goods.
3.The carrier(承运方) in such a case will disclaim liability with a notation like “SHIPPER’S(卖方)LOAD AND COUNT” or “SAID TO CONTAIN” on the bill of lading, particularly for goods that the carrier receives in sealed containers.
