document是英语中一个常用词,含义比较丰富。在法律英语的学习过程中,私以为不仅要掌握它的一些固定搭配,还要熟悉它的用法。

例When the insurer exercises the right of subrogation to indemnity claims, the insured shall provide the insurer with necessary documents and the related information in its knowledge.

[参考译文] 在保险人向第三者行使代位请求赔偿权利时,被保险人应当向保险人提供必要的文件和其所知道的有关情况。

document一词既可以作名词，也可以作动词。

1. 做名词

①文件或文书,是指能够传递一定信息的书面材料，如契约、债据等;

②书证，是指可以作为证据使用的材料,包括文书、照片、地图等;

③权利的证明文件。

2. 做动词

意思为“记录”。

例1 The book is highly documented.

[参考译文]这本书记录了大量史实。

例2 When the gage registration is to be handled, the designated documents or their copies shall be produced to the registration department.

[参考译文]办理抵押物登记时,应当向登记部门提供指定文件或其复印件。

例3 A foreign trade operator shall provide documents and materials related to its foreign trade activities to the local government.

[参考译文] 对外贸易经营者应当向地方政府提交与其对外贸易经营活动有关的文件及资料。

例4 Any document submitted as evidence must be the original.

[参考译文] 书证应当提交原件。

在法律英语中, document还有多种固定搭配,表示一些专有的法律概念,如document of title 和document bill。

document of title 长期以来, 在中国被翻译为“物权凭证”,其实是不准确的。document of title 是英美法上的特殊概念,商法中最重要的document of title就是提单(bill of lading)。实际上在英美法中,没有所谓“物权”或"物权法”的概念,而只有“财产”( property)或“财产法"(property law) 的概念。像提单这样的商业单据,实际上表征了物权法上的一种“占有”的法律事实,以及一种运输合同之债的请求权。所以,目前学界通常把document of title 翻译为“权利凭证”。

document bill 又可以叫documentary bills/ exchange,意思是;“跟单汇票”。在国际贸易中，跟单汇票是指发货人向收货人签发的附有可转让提单(negotiable bill of lading)、发票(invoice)和保险单( policy)等的汇票。据此,发货人可以得到货款。

例5 However，most personal property items do not have a formal document of title.

[参考译文] 尽管如此,大多数的个人财产没有正式的权利凭证。

例6 A document bill collection process is often used where there is an appreciable level of trust between the importer and exporter.

[参考译文] 跟单汇票托收通常在进出口商之间非常信任的情形下使用。
