第二， maintenance表示“唆讼；非法挑拨诉讼；包揽诉讼罪，非法资助诉讼罪”，包揽诉讼在普通法中是一项古老的刑事罪行，助讼通过为一方当事人无正当理由的起诉或者辩护提供帮助来不当挑起诉讼和纠纷。而帮讼分利是指那些本身不属诉讼中的任何一方，却出钱替当事人打官司，取得有利结果后分享诉讼利益的行为。挑唆是指挑拨唆使，即他人本无诉讼之意，行为人从中挑拨或唆使，而使其提起诉讼，行为人虽挑唆他人诉讼，但他人并末提出诉讼，则本罪仅属于未遂阶段，因本罪无未遂犯的处罚规定，故为刑法所不处罚的行为。包揽是指承包招揽诉讼。本罪中的所谓诉讼，包括民事、刑事与行政等诉讼。
