非法占用农用地罪，是指违反土地管理法规，非法占用耕地、林地等农用地，改变被占用土地用途，数量较大，造成耕地、林地等农用地大量毁坏的行为。

基本特征：

一、行为人必须违反土地管理法、森林法、草原法等土地法规以及有关行政法规中关于土地管理的规定。

二、行为人实施了非法占用耕地、林地等农用地，改变被占用土地用途的行为。“农用地”是指直接用于农业生产的土地，包括耕地、林地、草地、农田水利地、养殖水面等。具体知识参考《土地利用现状分类》。《森林法实施条例》规定，“林地”主要包括郁闭度0.2以上的乔木林地以及竹林地、灌木地、疏林地、采伐迹地、火烧迹地、未成林造林地、苗圃地和县级以上人民政府规划的宜林地。

Whoever, in violation of the laws and regulations on the management of nature reserves, conducts reclamation, development activities or constructs buildings in national parks or national nature reserves, causing serious consequences or other bad circumstances, shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention, and shall also be sentenced or only punished gold.

有前款行为，同时构成其他犯罪的，依照处罚较重的规定定罪处罚。

Those who commit the acts in the preceding paragraph and constitute other crimes at the same time shall be convicted and punished in accordance with the provisions on heavier punishment.
