买卖不破租赁(principle of "sales cannot break lease"),即在租赁关系存续期间,即使出租人将租赁物让与他人,对租赁关系也不产生任何影响,承租人仍有权使用租赁物。
《民法典》第七百二十五条:
租赁物在承租人按照租赁合同占有期限内发生所有权变动的,不影响租赁合同的效力。
相关司法解释规定:
租赁房屋在租赁期间发生所有权变动,承租人请求房屋受让人继续履行原租赁合同的,人民法院应予支持。但租赁房屋具有下列情形或者当事人另有约定的除外:
(一)房屋在出租前已设立抵押权,因抵押权人实现抵押权发生所有权变动的;
(二)房屋在出租前已被人民法院依法查封的。
我国法律上对买卖不破租赁原则的适用条件明确规定是土地、房屋等不动产,买卖不破租赁的四种例外:

【拓展】有形动产融资租赁,是指具有融资性质和所有权转移特点的有形动产租赁业务活动.即出租人根据承租人所要求的规格、型号、性能等条件购入有形动产租赁给承租人,合同期内设备所有权属于出租人,承租人只拥有使用权,合同期满付清租金后,承租人有权按照残值购入有形动产,以拥有其所有权.不论出租人是否将有形动产残值销售给承租人,均属于融资租赁。
