危害国家重点保护植物罪，是指违反国家规定，非法采伐、毁坏珍贵树木或者国家重点保护的其他植物的行为，或者非法收购、运输、加工、出售珍贵树木或者国家重点保护的其他植物及其制品的行为。情节严重的升格量刑。

《国家珍贵树种名录》和《国家重点保护野生植物名录》规定：

国家一级珍贵树木：主要有银杉、巨柏、银杏、水松、南方红豆杉、天目铁木、水杉、香果树等。

国家二级珍贵树木：主要有岷江柏木、秦岭冷杉、大别山五针松、红松、黄杉、红豆树、山槐、厚朴、水青树、香木莲等。

国家重点保护的其他植物：是指除珍贵树木以外的其他国家重点保护的植物，主要是国务院颁布的《国家重点保护野生植物名录》中所规定的植物。
