酒作为一种交际媒介，迎宾送客，聚朋会友，彼此沟通，传递友情，发挥了独到的作用。劝酒（force others to drink/urge sb. to drink)也成为了人们好客的一种表达方式。但是大家有可能不知道的是，参与劝酒也可能需要承担法律责任，甚至构成刑事犯罪。

劝酒需要承担法律责任的情形：

1、强迫性劝酒，用语言刺激对方喝酒，或在对方已喝醉、意识不清、没有自制力的情况下，仍劝其喝酒的行为；

2、明知对方不能喝酒仍劝其饮酒，诱发身体疾病等；

3、未安全护送醉酒者。；

4、酒后驾车未劝阻，导致发生车祸等损害的。

劝酒者需承担法律责任：

1、如果劝他人喝少量的酒，导致其疾病发作，根据公平责任原则，劝酒人要对给喝酒人造成的损失给予适当补偿；

2、如果劝他人喝大量的酒，造成他人伤残或者死亡后果的，劝酒人因过错侵害他人民事权益造成损害的，应当承担侵权责任。

3、如果明知他人酒精过敏，仍然灌酒、逼酒，则不仅要承担民事责任，造成他人重伤或者死亡的，还可能涉嫌过失致人重伤罪或过失致人死亡罪，还会被依法追究刑事责任。

4、如果确实有证据证明有人实施了强奸或猥亵行为，涉嫌构强奸罪或猥亵罪。
