私放在押人员（detainee）罪，是指司法工作人员私放在押的犯罪嫌疑人、被告人或者罪犯的行为。此罪名系行为犯，情节严重的升格量刑，情节特别严重的再次升格量刑。

失职致使在押人员脱逃罪，是指司法工作人员由于严重不负责任，致使在押的犯罪嫌疑人、被告人或者罪犯脱逃，造成严重后果的行为。此罪名系情节犯，造成严重后果是追究刑事责任的界限，情节特别严重的升格量刑。

《刑法》第400条第1款规定：

司法工作人员私放在押的犯罪嫌疑人、被告人或者罪犯的，处五年以下有期徒刑或者拘役；情节严重的，处五年以上十年以下有期徒刑；情节特别严重的，处十年以上有期徒刑。

《刑法》第400条第2款规定：

司法工作人员由于严重不负责任，致使在押的犯罪嫌疑人、被告人或者罪犯脱逃，造成严重后果的，处三年以下有期徒刑或者拘役；造成特别严重后果的，处三年以上十年以下有期徒刑。
