立案，是公安、司法机关及其它行政执法机关对于报案、控告、举报、自首以及自诉人起诉等材料，按照各自的管辖范围进行审查后，决定将其作为案件进行侦查或者审判。

侦查（investigations），是公安机关、国家安全机关、人民检察院和军队保卫部门依法进行的专门调查活动。是在刑事案件立案之后，收集证据、查明案情，确定是否起诉的准备程序。是刑事诉讼中的一个阶段。

立案和侦查的联系和区别：

1、立案是诉讼行为，侦查是查处行为

2、顺序不同，先立案后侦查

3、立案不一定为刑事犯罪

《公安机关办理刑事案件程序规定》第一百七十五条：

公安机关接受案件后，经审查，认为有犯罪事实需要追究刑事责任，且属于自己管辖的，经县级以上公安机关负责人批准，予以立案；认为没有犯罪事实，或者犯罪事实显著轻微不需要追究刑事责任，或者具有其他依法不追究刑事责任情形的，经县级以上公安机关负责人批准，不予立案。对有控告人的案件，决定不予立案的，公安机关应当制作不予立案通知书，并在三日以内送达控告人。

《刑事诉讼法》第一百一十五：

公安机关对已经立案的刑事案件，应当进行侦查，收集、调取犯罪嫌疑人有罪或者无罪、罪轻或者罪重的证据材料。对现行犯或者重大嫌疑分子可以依法先行拘留，对符合逮捕条件的犯罪嫌疑人，应当依法逮捕。

《刑事诉讼法》第一百一十六条：

公安机关经过侦查，对有证据证明有犯罪事实的案件，应当进行预审，对收集、调取的证据材料予以核实。

《刑事诉讼法》第一百六十八条：

人民检察院侦查终结的案件，应当作出提起公诉、不起诉或者撤销案件的决定。
