基因编辑（gene editing），又称基因组编辑（genome editing）或基因组工程（genome engineering），是一种新兴的比较精确的能对生物体基因组特定目标基因进行修饰的一种基因工程技术。2018年的“基因编辑婴儿”案中，贺建奎、张仁礼、覃金洲等3名被告人因共同非法实施以生殖为目的的人类胚胎基因编辑和生殖医疗活动，构成非法行医罪，分别被依法追究刑事责任。

2020年12月26日，《中华人民共和国刑法修正案（十一）》正式通过。刑法修正案（十一）对此类事件进行立法，填补了法律的空白。

参考法律法规：

刑法修正案（十一）草案规定，违反国家有关规定，非法采集我国人类遗传资源或者非法运送、邮寄、携带我国人类遗传资源材料出境，危害公众健康或者社会公共利益，情节严重的，处三年以下有期徒刑、拘役或者管制，并处或者单处罚金；情节特别严重的，处三年以上七年以下有期徒刑，并处罚金。

在刑法第三百三十六条后增加一条，作为第三百三十六条之一：

将基因编辑、克隆的人类胚胎植入人体或者动物体内，或者将基因编辑、克隆的动物胚胎植入人体内，情节严重的，处三年以下有期徒刑或者拘役，并处罚金；情节特别严重的，处三年以上七年以下有期徒刑，并处罚金。
