教育设施重大安全事故罪，是指明知校舍或者教育教学设施有危险，而不采取措施或者不及时报告，致使发生重大伤亡事故的行为。

其中，“重大伤亡事故”，一般是指造成死亡1人以上，或者重伤3人以上的。“后果特别严重”：

（1）造成死亡3人以上或者重伤10人以上，负事故主要责任的；

（2）具有造成死亡1 人以上，或者重伤3人以上的情形，同时造成直接经济损失500万元以上并负事故主要责任的，或者同时造成恶劣社会影响的。

《刑法》第138条规定：

明知校舍或者教育教学设施有危险，而不采取措施或者不及时报告，致使发生重大伤亡事故的，对直接责任人员，处三年以下有期徒刑或者拘役；后果特别严重的，处三年以上七年以下有期徒刑。
