我国是一个严格禁枪的国家，能合法持枪的人基本都是军人或警察。军人和警察丢失枪械，造成严重后果，将会面临行政处罚。

【丢失枪支不报罪】，是指依法配备公务用枪的人员，丢失枪支不及时报告，造成严重后果的行为。

构成此罪必须具备以下两个条件：

一、丢枪后“不及时报告”；如果行为人及时、如实报告自己丢失枪支的情况，则不能适用这个罪名。

二、丢枪的行为造成严重后果。“造成严重后果”，是指枪支丢失后被实施犯罪的行为人用于犯罪活动等情况。

【遗失武器装备罪】，是指军职人员遗失武器装备，不及时报告或者有其他严重情节的行为。

Any military personnel who loses weapons or equipment, fails to report in time or commits other serious acts and commits this crime shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention

《刑法》第129条：

依法配备公务用枪的人员，丢失枪支不及时报告，造成严重后果的，处三年以下有期徒刑或者拘役。

Any person lawfully equipped with guns used for official duties who loses his guns and fails to report them promptly, thus causing serious consequences, shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention.

《刑法》第441条：

军职人员遗失武器装备，不及时报告或者有其他严重情节的行为。犯本罪的，处三年以下有期徒刑或者拘役。

《最高人民检察院、公安部关于公安机关管辖的刑事案件立案追诉标准的规定（一）》第6条:

依法配备公务用枪的人员，丢失枪支不及时报告，涉嫌下列情形之一的，应予立案追诉：

（1）丢失的枪支被他人使用造成人员轻伤以上伤亡事故的；

（2）丢失的枪支被他人利用进行违法犯罪活动的；

（3）其他造成严重后果的情形。
