违规制造、销售枪支罪（Crime of manufacturing or selling guns in violation of regulations），是指依法被指定、确定的枪支制造企业、销售企业，违反枪支管理规定，以非法销售为目的，超过限额或者不按照规定的品种制造、配售枪支的行为，或者以非法销售为目的，制造无号、重号、假号的枪支的行为；或者非法销售枪支或者在境内销售为出口制造的枪支的行为。

《刑法》第126条规定：

依法被指定、确定的枪支制造企业、销售企业，违反枪支管理规定，有下列行为之一的，对单位判处罚金，并对其直接负责的主管人员和其他直接责任人员，处五年以下有期徒刑；情节严重的，处五年以上十年以下有期徒刑；情节特别严重的，处十年以上有期徒刑或者无期徒刑：

If an enterprise which is designed or determined according to law to engage in manufacture or sale of guns, in violation of the provisions on gun control, commits any of the following acts, the enterprise shall be sentenced to a fine and concurrently, the person-in-charge directly responsible and other persons directly responsible of the enterprise shall be sentenced to fixed-term of not more than five years; if the circumstances is serious, to fixed-term imprisonment of not less than five years and not more than ten years and; if the circumstance is especially serious, to a fixed-term imprisonment of not less than ten years or life imprisonment:

（一）以非法销售为目的，超过限额或者不按照规定的品种制造、配售枪支的；

To manufacture or sell guns exceeding the limit or not according to the type for the purpose of illegal sale;

（二）以非法销售为目的，制造无号、重号、假号的枪支的；

To manufacture guns without numbers or with same number or false number for the purpose of illegal sale; or

（三）非法销售枪支或者在境内销售为出口制造的枪支的。
