倒卖车票、船票罪（Crime of Scalping tickets），是指倒卖车票、船票，情节严重的行为。此罪名为情节犯，即情节严重的才构成犯罪，这是罪与非罪的区别。犯罪的对象是真实的车票、船票。

所谓倒卖（Scalping；Reselling；Resale；frandulent buying and selling；resold），是指从事商业活动的单位扮演了中间商的角色，低价买入高价卖出，赚取差额利润的一种经济活动，在市场经济条件下，是一种正常的现象，也是大部分商业活动的本质。

《刑法》第227条第2款规定

倒卖车票、船票，情节严重的，处三年以下有期徒刑、拘役或者管制，并处或者单处票证价额一倍以上五倍以下罚金。

《最高人民检察院、公安部关于公安机关管辖刑事案件立案追诉标准的规定（一）》第30条规定，倒卖车票、船票或者倒卖车票坐席、卧铺签字号以及订购车票、船票作证，涉嫌下列情形之一的，应予立案追诉：

（1）票面数额累计5000元以上的；

（2）非法获利累计2000元以上的；

（3）其他情节严重的情形。
