继续性合同，英文表达为Continuing Contract/Contracts for Performance of Recurring Obligation，是指不断的重复相同内容的合同，而不是一时或一次完成的合同。

如租赁合同、仓储合同均属于此类。租赁、借用、消费信贷等继续性合同以使用、收益、标的物为目的，已经被受领方享用标的物效益，是不能返还的，也就不能恢复原状。

非继续性合同，Non-continuing Contract，也叫一时性合同，是指履行为一次性行为的合同。

即一次给付便使合同内容实现的，如买卖、赠与、承揽等合同。

继续合同和非继续合同在是否溯及既往上有所不同：

继续性合同被解除时，或无恢复原状的可能性，或不宜恢复原状，故继续性合同被解除后仅向将来发生效力，解除前的合同关系不受影响；

非继续性合同解除后具有恢复原状的可能性，可以发生溯及既往的效力；

合同终止只适用于继续性合同，即债务不能一次履行完毕而必须持续履行方能完成的合同，如租赁合同、承揽合同、建设工程合同以及大部分以提供劳务为标的的合同；

合同的解除原则上只能适用于非继续性合同。
