法定代理人（legal representative）：是指根据法律规定，代理无诉讼行为能力的当事人进行诉讼，直接行使诉讼代理权的人。无诉讼行为能力的公民进行诉讼活动只能由其监护人为法定代理人代理其进行行政诉讼活动。法定代理人是全权代理，其法律地位相当于当事人，其代理权限不受限制，可以行使被代理享有的全部权利。

法定代理人不是当事人，属于诉讼参与人中的其他诉讼参与人。

委托代理人（authorized/commission agent），又称“受托人”。是指按照被代理人的委托行使代理权的人。代理人的一种。委托代理人可以是公民，也可以是法人；当委托代理人是公民时，他必须具有相应的民事权利能力。当委托代理人是法人时，所受托的事项必须符合其经营宗旨和业务范围。

委托代理人可以是一人，也可以是两人以上，前者称为“单独代理”或“一人代理”，后者称为“共同代理”。

Section 2 Litigation Representatives

《民诉法》第五十七条：

无诉讼行为能力人由他的监护人作为法定代理人代为诉讼。法定代理人之间互相推诿代理责任的，由人民法院指定其中一人代为诉讼。

For litigation-incompetent persons, their guardians shall be their legal representative in their litigations. If all legal representatives try to avoid their duties of representation, the people’s court may appoint one of them as the litigation represent.

《民诉法》第五十八条：

当事人、法定代理人可以委托一至二人作为诉讼代理人。

Each party or legal representative may appoint one or two persons to act as his litigation representatives.

律师、当事人的近亲属、有关的社会团体或者所在单位推荐的人、经人民法院许可的其他公民，都可以被委托为诉讼代理人。

Lawyers, a party’s near relatives, persons recommended by relevant public organizations or the units to which a party belongs, or any other citizens approved by a people’s court may be entrusted as the party’s litigation representatives.

It therefore leaves the matter in the hands of the body which pronounced legal incapacity; unless that body states otherwise there is a presumption that it permits the person deprived of capacity to accept the inheritance with the assistance of the curator or, if appropriate, the guardian in his capacity as legal representative of the person concerned and administrator of that person's property (however, under article 271(4) that person is also required to obtain court authorization to accept the inheritance without benefit of inventory or refuse it).
