虚假宣传(False propaganda或False advertising)是指在商业活动中经营者利用广告或其他方法对商品或者服务做出与实际内容不相符的虚假信息,导致客户或消费者误解的行为。虚假宣传违反诚实信用原则,违反公认的商业准则,是一种严重的不正当竞争行为。


虚假宣传的行为要点为:(1)虚假宣传的行为主体是广告主、广告代理制作者和广告发布者。(2)上述主体在客观上对其商品或服务做虚假广告或以其他方式进行虚假宣传。(3)上述虚假广告或虚假宣传达到了引人误解的程度,因而具有社会危害性。(4)在主观方面,广告经营者在明知或应知情况下,方对虚假广告负法律责任;对广告主,则不论其主观上处于何种状态,均必须对虚假广告承担法律责任。我国《反不正当竞争法》第24条第1款规定,经营者利用广告和其他方法,对商品作引人误解的虚假广告的,监督检查部门应责令停止违法行为,消除影响,并可根据情节处1万元以上20万元以下的罚款。
