“实质性相似”，英文表达为“substantial similarity”，指被告的作品与原告的作品在思想的表达方面构成同一。被告作品与原告作品达到了相当高的相似程度，以至于排除了被告独立创作作品的可能性。

英文释义：A strong resemblance between a copyrighted work and an alleged infringement, thereby creating an inference of unauthorized copying.

目前判断作品是否实质性相似的方法主要有三种：
