“Takedown notice”即“移除通知”，指的是内容所有人一旦发现网络上存在涉嫌侵犯其专有权的情况即向网站所有人、在线服务提供商等发出的移除该等内容的通知。发出移除通知的主体包括：社交媒体用户和参与者、（经内容所有人或版权所有人允许的）发布者、内容创作者或所有人、版权所有人、NFT所有人、代码编写者和发布者、（未经允许发布的）内容所涉主体。

为了使移除通知合法有效，移除通知须包含下列内容：

1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

获授权代表其专有权据称遭到侵犯的所有人行事之人的实体签名或电子签名。

2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.

3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material.

确认涉嫌侵权或属侵权活动且将被移除或禁止访问的内容，以及足以允许服务提供商定位内容的信息。

4. Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.

足以允许服务提供商联系投诉方的信息，比如，投诉方的地址、电话号码和电子邮箱（如有）。

5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

有关投诉方有足够理由相信被投诉内容的使用未经版权所有人、其代理人或法律授权的声明。

6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

有关通知所涉信息均属准确，且投诉方有权代表其专有权据称遭到侵犯的所有人行事，如有不实愿受伪证罪惩罚的声明。

此外，若认为相关内容被错误移除，可针对“takedown notice”向服务提供商发出“counter notice”（反移除通知），对移除通知中的权利要求提出质疑，并要求恢复被移除的内容，前提是，移除通知已发出且涉嫌侵权的内容已移除。

为了使反移除通知合法有效，反移除通知须包含下列内容：

1. A physical or electronic signature of the subscriber.

用户的实体签名或电子签名。

2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.

确认已移除或禁用的内容及相关内容移除或禁用前所在地址。

3. A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

有关用户有足够理由相信移除或禁用相关内容是基于错误或错认导致的，如有不实愿受伪证罪惩罚的声明。

4. The subscriber’s name, address, and telephone number, and a statement that the subscriber consents to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if the subscriber’s address is outside of the United Sates, for any judicial district in which the service provider may be found, and that the subscriber will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
