被执行人（person subjected to execution或person subject to execution）是指在法定的上诉期满后，或终审判决作出后，未履行法院判决或仲裁裁决，并进入执行程序的当事人。在法院对于民事诉讼判决原告胜诉后，被告在赔偿问题上的法定时间内未完成判决书上所规定的赔偿金额而被法院强制执行赔偿，则称该被告为本次强制执行的被执行人。

我国法律对被执行人进行了一系列规定，主要有：

（1）被执行人负有在收到人民法院执行通知书后按照其指定的履行期限积极履行生效法律文书内容的义务。未按执行通知书履行义务的，应当报告当前以及收到执行通知之日前一年的财产情况。被执行人拒绝报告或者虚假报告的，人民法院可以根据情节轻重对被执行人或者其法定代理人、有关单位的主要负责人或者直接责任人员予以罚款、拘留。

（2）被执行人拒不履行或规避执行以及拒绝递交财产报告的，人民法院将对被执行人予以罚款、拘留措施（对个人的罚款金额为十万元以下，对单位的罚款金额为一百万元以下；拘留期限为十五日以下），同时采取限制出境、在征信系统记录、通过媒体公布不履行信息以及法律规定的其他措施。构成犯罪的，依法追究刑事责任。
