除斥期间，也称不变期间，是指法律对某种权利规定的存续期间。其法律意义在于，督促权利人尽快行使权利，超过除斥期间怠于行使该权利的，则该权利消灭。它主要适用于形成权。

其英文为statute of repose。亦指除斥期间法。A statute of repose (sometimes called a nonclaim statute), like a statute of limitations, is a statute that cuts off certain legal rights if they are not acted on by a specified deadline.

除诉期间是一种比较少见的美国法律用语，其与通常的诉讼时效期间的区别在于：除诉期间与诉因的形成无关，其从某一特定事件的发生之日起计算，而不管诉因是否已经发生或是否已造成损害，例如规定自被告实施某一特定行为(例如制造产品或完成工作)之日起若干年后不得再行提起诉讼，即使原告的损害发生于该期限届满之后。诉讼时效期间则以诉因形成之日起计算，例如规定自原告遭受损害之日起经由某一特定时期而原告未起诉的，则不得再行起诉。诉讼时效法〔statute of limitation〕本身即是除诉期间法，它们的目的均在于阻止当事人对失效请求权〔stale claim〕提出主张。

我国《民法典》有关除斥期间的规定如下：

第一百九十九条　法律规定或者当事人约定的撤销权、解除权等权利的存续期间，除法律另有规定外，自权利人知道或者应当知道权利产生之日起计算，不适用有关诉讼时效中止、中断和延长的规定。存续期间届满，撤销权、解除权等权利消灭。

Article 199 The time period within which a right holder may exercise certain rights, such as the right to revocation and the right to rescission, which are provided by law or agreed by the parties shall begin, unless otherwise provided by law, from the date when the right holder knows or should have known that he has such a right, and the provisions on the suspension, interruption, or extension of the limitation period are not be applicable. Upon expiration of the time period, the right to revocation, the right to rescission, and the like rights are extinguished.

第五百四十一条　撤销权自债权人知道或者应当知道撤销事由之日起一年内行使。自债务人的行为发生之日起五年内没有行使撤销权的，该撤销权消灭。

Article 541 The right to revocation shall be exercised within one year from the date on which the creditor knows or should have known the cause for the revocation. The right to revocation is extinguished where a creditor does not exercise such right within five years since the date on which the debtor conducts the relevant act.
